해양수산부는 올해 처음으로 '우수 물류신기술 등 지정제도'를 시행한다. 해수부는 국내 최초로 개발됐거나 외국에서 도입해 개량된 항만물류 분야의 우수한 물류신기술을 발굴해 지정한다는 계획이다.
The Ministry of Maritime Affairs and Fisheries is implementing the 'Designated System for Excellent Logistics New Technology' for the first time this year. The Ministry of Oceans and Fisheries plans to discover and designate excellent new logistics technologies in the field of port logistics that were developed for the first time in Korea or introduced and improved in foreign countries.
접수된 기술은 신기술 여부 확인 과정을 거치고, 이후 신규성, 기술성, 경제성 등을 평가한다. 신규성은 기존에 없던 새로운 것으로, 특허성의 시험으로 그에 따라 발명이 특허가 될 수 있는지 아니면 이전에 이미 청구된 적이 있어 특허가 될 수 없는지를 판가름하는 기준이다.
The received technology goes through the process of checking whether it is a new technology, and then evaluates novelty, technology, and economics. Novelty is a new one that has not existed before, and is a criterion for determining whether an invention can be patented according to the test of patentability or not because it has been previously claimed.
신규성으로 인정받지 못하는 발명은 특허 출원 전에 국내 또는 국외에서 공지된 발명, 공연히 실시된 발명, 반포된 간행물에 게재된 발명, 전기통신 회선을 통하여 공중이 이용할 수 있는 발명이다.
Inventions that are not recognized as novelty are inventions known in Korea or abroad before patent application, inventions performed in public, inventions published in distributed publications, and inventions that can be used by the public through telecommunication lines. [정리 = 함용남 시사법률 크리에이터]
