최근 상속 및 증여에 따른 법적 분쟁이 늘고 있는 추세다. 법원행정처에 따르면 상속재산분할청구 건 접수는 △2016년 1233건, △2017년 1430건, △2018년 1710건으로 매년 높아지고 있다. 유류분반환청구 건 또한 2008년 295건에서 2018년 1371건으로 10년 사이 약 4.6배 급증했다. Recently, legal disputes due to inheritance and donation are increasing. According to the court administration, the number of requests for division of inherited property is increasing every year to △ 1233 cases in 2016, 1430 cases in 2017, and 1710 cases in 2018. The number of requests for return of remained has also surged 4.6 times in 10 years from 295 in 2008 to 1371 in 2018.
공동상속인 중 1인이 상속부동산에 관한 단독 명의의 소유권이전등기를 마쳤다. 원인은 협의분할에 의한 상속이다. 이 경우 다른 공동상속인이 무효를 주장한다. 자신의 동의 없이 협의분할이 이루어졌다는 이유이다. 따라서 그는 그 등기의 말소를 청구한다. 이것은 상속회복청구에 해당한다.
