[경찰] 다음달 성년맞는 ‘부따’ 강훈, 이전 범죄에도 소년법 ‘적용불가’

서울지방경찰청은 강훈을 검찰에 송치했다. 강훈은 아동·청소년의 성보호에 관한 법률 위반 등 혐의로 구속됐다.
The Seoul Metropolitan Police Agency sent Kang Hoon to the prosecution. Kang Hoon was arrested for alleged violations of the Act on the Protection of Sex in Children and Youth.
‘박사방’ 공동 운영자로 지목된 강훈(대화명 ‘부따’)은 현재 만 18세이다. 다음달 성년을 맞게 된다. 그런 만큼 이전 범죄에 대해서도 소년법 감경 등의 적용을 받을 수 없는 것으로 나타났다. 대법원은 소년 여부에 대한 판단시점을 ‘범죄행위 시’로 보지 않는다. ‘사실심 판결 선고 시’를 기준으로 하고 있다.
Kang Hoon, who was named co-operator of Paksabang, is currently 18 years old. The next month will be mature. As such, it was found that the previous crimes could not be applied, such as reduction of juvenile law. The Supreme Court does not view the judging point of whether or not a boy is a “criminal time”. It is based on the ‘declaration of fact judgment’.
