민법이 규정한 유류분 제도는 재산처분의 자유라는 재산권의 본질적인 내용을 침해한다는 주장이 나왔다. 따라서 유류분 제도는 위헌이라는 주장이 제기됐다.
It has been argued that the Reserve system prescribed by the Civil Code violates the essential content of the property right to freedom of property disposal. Therefore, it was argued that the Reserve system is unconstitutional.
이 같은 주장은 법무법인 지평 전남 순천사무소 임형태 변호사로부터 나왔다. 임 변호사는 유류분 반환 소송과 관련, 서울 동부지법에 위헌법률심판제청 신청서를 제출했다고 밝혔다.
The claim came from lawyer Lim Hyung-hyung of the Jipyeong Jeonnam Suncheon office. Attorney Lim said that he has submitted an application for an unconstitutional jurisdiction to the Seoul Eastern District Court regarding the lawsuit to return reserve.
