[政街] 양정숙, 제명 除名 소송 Yang Jeong-suk, the lawsuit against striking off a name


부동산 의혹으로 양정숙 당선인 當選人이 더불어시민당에서 제명됐다. Due to suspicion of real estate, President-elect Yang Jeong-suk was removed from the Citizens' Party. 이에 양 당선인은 당 黨을 상대로 제명에 대한  소송을 제기했다. Accordingly, Yang president-elect filed a lawsuit against the party for dismissal. 법조계에 따르면 양 당선인은 더불어시민당의 제명 결정이 무효 無效라며 서울남부지방법원에 제소했다. According to the legal community, Yang president-elect filed a complaint with the Seoul Southern District Court, saying that the Citizen Party's decision to dismiss was invalid.

추인은 민법상 불완전한 법률행위를 사후 事後에 보충하여 유효하게 만드는 일방적 의사표시이다. 그러나 무효행위의 추인 追認의 경우는 다르다. Ratification is a unilateral intention to make  incomplete legal acts in civil code being effective as supplemented after the fact. However, the case of a ratification of the invalidity act is different.

무효인 법률행위 法律行爲를 추인하였다. 그렇다고 하여 원칙적으로 그 효력이 생기는 것은 아니다. Invalid legal acts were identified. This does not, in principle, take effect. <발췌정리 = 함용남 국민국회 크리에이터>
