법정지상권
토지와 건물이 동일인에 속하는 상태이다. 이 상태에서 건물에만 제한물권이 설정되었다. 그러나 나중에 토지와 건물의 소유자가 달라졌다. 이 경우에 건물소유자를 보호하기 위하여 법률로 인정하는 지상권을 말한다. 법률상 당연히 성립하는 지상권이므로 등기 없이 성립하는 물권이다.
