[종교] 이재명 “정당한 공무행위 방해..종교 자유가 아닌 불법행위”

이재명 경기도지사가 코로나19 예방수칙을 지키지 않거나 예방수칙 준수여부를 확인하러 나온 공무원 교회 출입을 막는 등 고의로 공무를 방해한 20개 교회에 ‘감염병예방수칙 준수 등 집회제한 행정명령’을 내렸다.
Governor Lee Jae-myeong issued ‘administrative order to restrict meetings such as observing the infectious disease prevention rules’ to 20 churches who deliberately interfered with the public affairs, such as preventing the corona19 preventive measures or blocking the entrance of officials from the church to check whether the regulations were observed.
이 지사는 “신천지측이 여전히 방역조치에 성실하게 따르지 않고 있다는 판단에 따라 도내 427개 신천지 시설에 대한 시설 폐쇄와 집회금지 명령은 계속 유지합니다. 일부 종교단체에서 경기도 조치를 두고 예배금지로 종교탄압을 했다며 정당한 도정을 음해하고 있습니다. 분명히 말하지만 경기도는 예배를 금지한 것이 아니라 집합예배를 하되 모두의 안전을 위해 국민으로서 지켜야할 수칙의 준수를 법에 따라 요구한 것뿐입니다”라고 했다.
The governor said, “We continue to maintain orders to shut down and ban assembly at 427 Sincheonji facilities in the province, as judged by the administration is still not faithfully following the quarantine measures. Some religious groups are accusing the city of Gyeonggi-do and opposing religious lawsuits against religious worship. Clearly, Gyeonggi-do is not forbidden to worship, it is a group worship service, but for the safety of all, it is only a law that requires the observance of the rules to be observed as citizens. ”
불법행위 성립요건으로서의 위법성은 관련 행위 전체를 일체로만 판단하여 결정하여야 하는 것은 아니고 문제가 되는 행위마다 개별적·상대적으로 판단하여야 할 것이므로, 어느 시설을 적법하게 가동하거나 공용에 제공하는 경우에도 그로부터 발생하는 유해 배출물로 인하여 제3자가 손해를 입은 경우에는 그 위법성을 별도로 판단하여야 한다. 이 경우 판단 기준은 유해의 정도가 사회통념상 일반적으로 참아내야 할 정도를 넘는 것인지 여부이다.
In that the illegality as a requirement for the establishment of a tort ought to be judged not by the integral determination on the whole related acts but by the separate and relative determination on each act in question, the illegality ought to be separately determined in a case where a third person is damaged by harmful emissions resulting from a facility which is legitimately operated or provided for the public.
