7년간 5억 원의 불법 리베이트를 수수하고 집행유예 확정 판결을 받은 의사의 면허를 취소하는 것은 정당하다는 법원의 판결이 나왔다.
The court ruled that it was justifiable to revoke the license of a doctor who received a 500 million won illegal rebate for seven years and was determined to be suspended.
재판부는 "형법 제 40조 '상상적 경합'에 의해 여러 개의 범죄 행위 중 가장 법정형이 높은 1개의 형으로 처벌하는 것은 나머지 죄는 처벌하지 않겠다는 의미가 아니다"고 판시했다.
The judiciary judged that punishing one of the highest criminal sentences among several criminal acts under Article 40 'Imaginative Contention' of the Criminal Code does not mean not punishing the rest of the crimes. "
상상적 경합은 1개의 행위가 수개의 죄에 해당하는 경우를 말한다.
Imaginative contention is when one act corresponds to several sins.
공무원이 취급하는 사건에 관하여 청탁 또는 알선을 할 의사와 능력이 없었다. 그럼에도 불구하고 그 공무원은 청탁 또는 알선을 한다고 기망하고 금품을 교부받았다. 이 경우에는 사기죄와 변호사법위반죄가 성립한다. 그리고 두 죄는 상상적 경합 관계에 있다.
There was no intention and ability to request or mediate the case handled by public officials. Nevertheless, the official was to ask for or mediate and was given a gift.
