한국자산관리공사(캠코)는 온비드(온라인 공공자산처분시스템)에서 압류재산 836건(839억원 규모)을 공매한다.
The Korea Asset Management Corporation (CAMCO) publicly sells 836 seized property (83.9 billion won) from On-Bid (online public asset disposal system).
공매 물건 중 아파트, 주택 등 주거용 건물이 83건이다. 공매 시작가격이 감정가의 70% 이하인 물건도 261건 포함됐다.
83 of the publicly sold items are residential buildings such as apartments and houses. Also included were 261 items whose starting price was less than 70% of the assessed value.
공매 물건은 세무서와 지방자치단체 등 공공기관이 체납세액을 징수하고자 캠코에 매각을 의뢰한 것이다.
Publicly sold items are sold by Kampco to collect arrears taxes by public institutions such as tax offices and local governments.
유체동산을 압류하거나 가압류한 뒤 매각기일에 이르기 전에 다른 강제집행이 신청된 때에는 집행관은 집행신청서를 먼저 압류한 집행관에게 교부하여야 한다. 이 경우 더 압류할 물건이 있으면 이를 압류한 뒤에 추가압류조서를 교부하여야 한다.
When a request is filed for another compulsory execution before arriving at the date of auction subsequent to a seizure or provisional seizure of corporeal movables, an execution officer shall deliver a written request for execution to the execution officer who has made an earlier seizure. In such cases, if there exist any objects to be additionally seized, the execution officer shall deliver the protocol of additional seizures, subsequent to their seizure.
집행에 관한 채권자의 위임은 먼저 압류한 집행관에게 이전된다.
An entrustment of execution by the creditor shall be transferred to the execution officer who has made an earlier seizure.
각 압류한 물건은 강제집행을 신청한 모든 채권자를 위하여 압류한 것으로 본다.
Respective seized objects shall be deemed to have been seized for the sake of all creditors who have requested compulsory execution.
먼저 압류한 집행관은 뒤에 강제집행을 신청한 채권자를 위하여 다시 압류한다는 취지를 덧붙여 그 압류조서에 적어야 한다.
An execution officer who has made an earlier seizure shall make an entry in such protocol by attaching the purport that a second seizure is effected for the sake of the creditors who have subsequently made a request for compulsory execution.
‘매각기일에 이르기 전’이라 함은 ‘실제로 매각이 된 매각기일에 이르기 전’을 의미하는 것으로서 그때까지의 이중압류는 허용된다고 보아야 한다.
